Il bene “farmaco” conosce una regolamentazione che può esse-re definita come «multidirezionale» e «multilivello»: da un la-to, infatti, chiama in causa una pluralità di questioni giuridi-che di rilevanza costituzionale e, dall’altro, si colloca su diversi livelli normativi (che vanno dalla dimensione internazionale a quella substatale). Da questa seconda prospettiva, osservatorio particolarmente privilegiato è costituito dagli ordinamenti fe-derali, la cui analisi consente di verificare quali aspetti del “di-ritto del farmaco” hanno raggiunto un significativo livello di armonizzazione e quali, invece, sembrano resistere ad essa. Unitamente a quelle di Stati Uniti e Canada, vengono indagate le esperienze dell’Unione europea (per via del peculiare federa-lizing process che ne caratterizza l’evoluzione) e di alcune “democrazie emergenti”, quali India e Brasile che, nonostante rappresentino i principali mercati farmaceutici tra le economie del “Sud del mondo”, scontano tuttora – specie in termini di accesso ai farmaci essenziali – un marcato divario rispetto ai Paesi del “Nord del mondo”.
