Ai sensi della Convenzione di Montreal del 28 maggio 1999, ove il vettore aereo internazionale si renda responsabile del ritardo nella consegna al passeggero del proprio bagaglio, la limitazione della responsabilità risarcitoria dello stesso vettore fissata dall'art. 22, n. 2, della Convenzione opera in riferimento al danno di qualsiasi natura patito dal passeggero medesimo e, dunque, sia nella sua componente meramente patrimoniale, che in quella non patrimoniale, da risarcirsi, quest'ultima, (allorquando, come nella specie, trovi applicazione il diritto interno) ai sensi dell'art. 2059 cod. civ., come conseguenza seria della lesione grave di diritti inviolabili della persona, costituzionalmente tutelati.
