El presente artículo pretende abordar el tema de la criminalidad en torno a los indios de la Cordillera de Mérida a finales del siglo XVIII y principios del siglo XIX a través de dos juicios cuyos expedientes reposan en el Archivo General del Estado Mérida. El primer caso, trata de un sumario de 1800, seguido para averiguar las causas por las cuales un indio de la población de Ejido fue violentamente golpeado por un "vecino". Aquí se evaluará la importancia de la condición social y económica del indio como variable del crimen y la agresión. El segundo caso (1796) está referido a una causa por las \nresunciones sobre un labrador de Timotes que habría dado muerte a un indio. En este caso se determinarán los motivos circunstanciales del hecho y la condición social como condicionante y objeto de la agresión, así mismo las implicaciones del sistema punitivo con respecto a los procedimientos de la defensa.
