Lâarbitrage religieux : contexte international et national. La meÌdiation comme solution aÌ son interdiction ?

Abstract
La thèse qui sera soutenue tout au long de ce mémoire sera lâéventuelle création de tribunaux religieux en Belgique. A cet effet, nous analyserons la situation de trois pays qui ont décidé dâintégrer ou de rejeter lâarbitrage religieux dans leurs systèmes juridiques respectifs après un bref exposé des diverses notions qui seront abordées tout au long de notre étude. Nous évoquerons donc, la situation des Etats-Unis, du Canada et de la Grande-Bretagne. Afin dâavoir une vue générale sur la question, nous tâcherons dâanalyser les différents arbitrages religieux existants au sein de ces pays. Nous concentrerons dès lors notre expertise sur les trois grandes religions offrant la possibilité pour leurs fidèles de régler les conflits en appliquant leurs droits religieux. Nous y évoquerons les diverses institutions ainsi que leur organisation et la reconnaissance des décisions que celles-ci prendront. Nous analyserons ensuite la possible création de ce type de tribunaux dans lâordre juridique belge. A cet effet nous nous pencherons sur le cadre juridique belge en matière dâarbitrage. Nous évoquerons notre position sur la question. Nous terminerons notre étude sur la problématique de la médiation comme solution à « lâinterdiction » des tribunaux religieux en Belgique. Nous analyserons la profession de médiateur et sa compatibilité avec une fonction religieuse.
