Abstract
La positiva conclusione della conferenza diplomatica che ha portato alla sottoscrizione della Convenzione di Montreal del 28 maggio 1999, destinata verosimilmente a raggiungere in tempi relativamente brevi le condizioni per l'entrata in vigore, fa prefigurare una sostanziale evoluzione della disciplina di diritto uniforme del trasporto aereo, che, al di là dei molti fermenti e delle varie iniziative unilaterali, risaliva nelle sue linee essenziali ad un'epoca in cui il fenomeno che era chiamata a regolare stava attraversando ancora la sua fase pionieristica. Peraltro, le linee fondamentali della disciplina della Convenzione di Montreal relativa al danno per morte o lesione dei passeggeri nel trasporto di persone è stata in parte anticipata, a livello europeo, dal regolamento CE n. 2027/97 del Consiglio del 9 ottobre 1997 sulla responsabilità del vettore aereo in caso di incidenti che comportino danni alla persona del passeggero.
