Abstract
L'objet de cette recherche est le problème de l'égalité rapporté À la formation de l'Etat au Canada, dans la période allant de 1791 à la confédération. L'hypothèse générale en est que la question de l'égalité est ce par quoi on a problématisé l'autonomie de l'Etat au Canada. Il s'agit, à travers la reconstruction de la polémique liée à la qualité de sujet britannique au Bas-Canada et au problème de la représentation politique dans le Canada-Uni, de montrer comment la légitimité de l'Etat canadien se fonde sur le rejet de l'individualisme. Rejet qui se vérifiera, au moment de la formation de l'État canadien, dans la mise en place des formes institutionnelles des sphères publique et privée. Ainsi, le système du droit privé et le dispositif constitutionnel de la représentation politique exprimeront ils la mise en oeuvre du modèle canadien de l'égalité tel qu'il émerge de la période précédente.
