Les municipalités québécoises manifestent une volonté claire d’agir dans le but de favoriser le développement économique de leur territoire et leurs interventions dans la sphère économique sont nombreuses et variées. Le présent mémoire porte sur l’action municipale en matière de développement économique et présente le cadre juridique de cette action en mettant en opposition l’autonomie municipale et le contrôle centralisé. En premier lieu, il expose certains fondements conceptuels, historiques, juridiques et sociopolitiques de l’action municipale en matière de développement économique. Par la suite, il examine les moyens dont disposent les municipalités ainsi que les limites qui sont imposées à leur action, et ce, par une analyse approfondie de la législation municipale et de la jurisprudence. Enfin, il s’intéresse au droit applicable dans la province de l’Ontario et dans l’État américain de l’Ohio. Il établit certains parallèles avec ces droits étrangers, lesquels permettent de voir apparaître à la fois des fortes similitudes et des différences fondamentales. Cet exercice de comparaison permet d’alimenter l’analyse critique du droit québécois, laquelle mène à certains constats au sujet de l’approche retenue jusqu’à présent par les autorités législatives québécoises, ainsi qu’à un début de réflexion sur des nouvelles manières d’encadrer l’action municipale en matière de développement économique.
