Abstract
L’objectif de ce travail est de tenter de comprendre le rôle du consentement des femmes au cœur de l’idéologie démocratique libérale. Mon hypothèse est que le consentement sexuel est une « condition nécessaire, quoique non suffisante, d’un monde habitable par tous », pour reprendre l’expression de Claude Lefort. Après une politisation de la problématique des violences sexuelles dans les années 70 par les féministes, on assiste à partir des années 90 à une dépolitisation de l’action publique par une nouvelle coalition antiféministe. La réalité sociale des violences sexuelles envers les femmes est niée ainsi que leur subjectivité, la loi ne leur garantit pas le droit à l’intégrité et la liberté sexuelle, notamment à cause d’une présomption de consentement des femmes issue du contrat social classique bien ancré dans la société. Reconnaître le consentement des femmes invite à une réflexion pour un changement législatif vers un consentement positif sur le modèle canadien.
