Abstract
28 października Komisja Europejska w odpowiedzi na wniosek niemieckiego regulatora ogłosiła\ndecyzję określającą warunki większego wykorzystania przepustowości lądowej odnogi\nNord Stream – gazociągu OPAL – przez rosyjski koncern gazowy Gazprom (i ewentualnie inne\nfirmy). Decyzja ta rodzi szereg pytań ze względu na treść, tryb, kontekst jej wydania oraz możliwe\nkonsekwencje. Wątpliwości potęguje nieprzejrzystość informacji dotyczących zarówno\nsamego gazociągu OPAL i pierwotnych zasad jego wykorzystania (w tym wyłączenia z zasady\ndostępu strony trzeciej – TPA), jak i obecnej decyzji KE. W rezultacie decyzja Komisji rodzi\nsprzeczne reakcje. Z jednej strony widziana jest (m.in. przez stronę polską czy ukraińską) jako\nułatwiająca Gazpromowi większy dostęp do rynku europejskiego kosztem bezpieczeństwa\ndostaw do Europy Środkowej i tranzytu przez Ukrainę, z drugiej zaś – jako niespełniająca\noczekiwań Gazpromu i operatora OPAL, szukających większych możliwości długoterminowego\nrezerwowania przepustowości gazociągu. Nie jest więc pewne, kiedy oraz czy w ogóle\nwarunki wykorzystania OPAL w zaproponowanym przez KE kształcie zostaną wdrożone,\na w konsekwencji – czy podjęta decyzja zakończy wieloletni proces negocjacji zasad wykorzystania\nniemieckiego gazociągu.
