Abstract
Pienet tilitoimistot ovat yleensä yrittäjävetoisia ja niiden työntekijä- ja aikaresurssit ovat rajalliset. Näistä syistä johtuen toimeksiantosopimukset on saatettu tehty puutteellisesti tai niitä ei ole tehty ollenkaan. Kun kirjallista sopimusta toimeksiannosta ei ole tehty, osapuolilla voi olla eri käsitys toimeksiannon laajuudesta tai siitä, onko lopullista toimeksiantoa edes annettu. \n \nToimeksiantosopimuksessa tilitoimisto sitoutuu ottamaan asiakasyrityksen taloushallinnolliset tehtävät hoitaakseen. Taloushallintoliiton laatiman vakiosopimuksen hyödyntäminen voi olla tilitoimistolle aikaa säästävä ja kustannustehokas ratkaisu. Tällaisen sopimuksen hyödyntäminen kuitenkin edellyttää, että sopimuksia tekevät henkilöt tuntevat vakiosopimuksen sisällön, sen ehdot sekä siihen liittyvät sopimusoikeudelliset seikat kokonaisvaltaisesti. Jos tällaista tietämystä ei ole, voivat sopimusriskit kasvaa suuriksi ja mahdolliset riitatilanteet tulla erittäin kalliiksi. Yrittäjä voi tulla jopa solmineeksi toimeksiantosopimuksen täysin huomaamattaan. \n \nTämän opinnäytetyön tarkoituksena oli laatia pienelle tilitoimistolle ja sen yrittäjälle sopimusoikeudellinen tietopaketti toimeksiantosopimusten tekemistä varten. Työn tavoitteena oli lisätä tilitoimistoyrittäjän ja toimeksiantosopimusten parissa työskentelevien työntekijöiden sopimusoikeudellista tietoutta. Työ toteutettiin toiminnallisena opinnäytetyönä. Lähdemateriaalina toimivat lainsäädäntö, oikeuskirjallisuus, alan kirjallisuus, artikkelit sekä vapaamuotoiset haastattelut toimeksiantajayrityksen yrittäjän, työntekijöiden sekä Suomen Taloushallintoliitto ry:n asiantuntijoiden kanssa. Työssä keskityttiin ainoastaan sellaisiin tilitoimiston toimeksiantosopimuksiin, jotka on tehty hyödyntäen Taloushallintoliiton laatimaa vakiomuotoista toimeksiantosopimusta TAL2018. \n \nTyön lopputuloksena syntyi tiivis ja helppokäyttöinen opas, jota toimeksiantajayritys ja myös muut halukkaat voivat hyödyntää haluamallaan tavalla tilitoimistojen sopimusprosessissa. Oppaassa on huomioitu tilitoimiston toimeksiantosopimuksen luonne ja sen erot muihin sopimustyyppeihin. Myös vakiosopimuksen käyttöön liittyvät kysymykset ja erityispiirteet on otettu oppaassa huomioon.
