Abstract
L’8 giugno 2023 il Canada e i Paesi Bassi hanno presentato un ricorso congiunto dinanzi alla Corte internazionale di giustizia (CIG) denunciando la violazione di diverse disposizioni della Convenzione contro la tortura e altre pene o trattamenti crudeli, inumani o degradanti da parte della Siria. Contestualmente, gli Stati ricorrenti hanno formulato una richiesta separata ai sensi dell’art. 41 dello Statuto della Corte, finalizzata all’ottenimento di misure provvisorie intese a prevenire un possibile pregiudizio grave e irreparabile a danno dei diritti tutelati dalla Convenzione. Il presente contributo esamina l’ordinanza sulle misure provvisorie resa dalla CIG il 16 novembre 2023, soffermandosi altresì sui potenziali vantaggi che sarebbero potuti derivare dall’accoglimento di alcune delle misure richieste dagli Stati ricorrenti e non considerate dalla Corte.
