Abstract
L’une des missions principales du droit en général, et du droit privé en particulier, réside dans sa capacité de protéger les personnes vulnérables contre toute forme d’exploitation. Cette mission interpelle, plus que jamais, les différents systèmes juridiques, tous confrontés à des phénomènes de limitation des ressources, de vieillissement de la population et d’écarts croissants de richesses des divers acteurs économiques et sociaux. Ces journées ont pour objectif, de manière comparative, pragmatique et multidisciplinaire, de mettre en lumière ces enjeux et les solutions que les différents systèmes juridiques apportent. Séance 1 (Université de Montréal, 28 mai 2018) : Vulnérabilité et aptitude Protection des personnes dont l’aptitude à prendre une décision libre et éclairée pose des enjeux : acte juridique et capacité, responsabilité et faculté de discernement, exploitation des personnes âgées.
