De grondwetgever kan overigens, bij de wijziging van ar�kel 120 Gw, duidelijk maken dat hij dit van de rechter verwacht: toetsing dient immers nu�g te zijn. Wijziging van de grondwettelijke beperkingssystematiek-Er kan ook voor gekozen de beperkingssystema�ek aan te passen en meer toe te snijden op de nieuwe rechterlijke toetsingsbevoegdheid. Die benadering levert meer duidelijkheid en voorspelbaarheid op, en kan de rechter behoeden voor verwijten van ac�visme.Het nadeel van zo'n wijziging is dat zij veel �jd in beslag neemt en (a�ankelijk van de gemaakte keuzes) een aanzienlijke wetgevingsopera�e met zich brengt.-Het meer toesnijden van de beperkingssystema�ek op rechterlijke toetsing kan op verschillende manieren gebeuren.Gekozen kan worden voor:(1) een aanvullende algemene beperkingsclausule met propor�onaliteitseis en kernrechtbepaling, (2) een algemene aanvullende beperkingsclausule met propor�onaliteit, zonder kernrechtbepaling, (3) een algemene beperkingsclausule die in de plaats komt van de bestaande beperkingsclausule in elk afzonderlijk grondrecht of (4) wijziging van elk van die afzonderlijke beperkingsclausules.(5) Ook zou kunnen worden gewerkt met een coördina�ebepaling, die voorschrij� dat de onderscheiden beperkingssystema�eken (Grondwet, EVRM en Handvest) tezamen dienen te worden toegepast, en dat de ruimste bescherming voor gaat.42
