Abstract
Suomen metsänomistajat vanhenevat, metsätilan sukupolvenvaihdoksia tapahtuu ja niiden yhteydessä metsätilojen hallintaoikeuksia pidätetään. Metsätilan hallintaoikeus tarkoittaa sitä, että metsän omistus siirtyy eteenpäin, mutta oikeus hallita metsää jää hallintaoikeuden haltijalle. Metsätilojen hallintaoikeuden haltijoista osa päätyy väistämättä edunvalvontaan. Edunvalvojan tehtävänä on huolehtia päämiehensä taloudellisista asioista. Jos päämiehen omaisuuteen kuuluu metsätilan hallintaoikeus, edunvalvoja vastaa myös siitä. Metsätilan hallintaoikeudet on laaja-alainen asia ja niiden käsittely edunvalvonnassa vaatii monen eri seikan huomioon ottamista. Metsätilan hallintaoikeuden haltija päämiehenä voi olla edunvalvojalle melkoinen haaste. \n \nTässä opinnäytetyössä perehdyttiin edunvalvontaan ja päämiehen itselleen pidättämään metsätilan hallintaoikeuteen. Tarkemmin sanottuna metsätilan hallintaoikeuden arvostamiseen omaisuusluettelossa ja vuositilissä sekä siihen, mitä asioita edunvalvojan ainakin tulisi osata ottaa huomioon toimissaan, kun päämiehen omaisuuteen kuuluu päämiehelle pidätetty metsätilan hallintaoikeus. Edunvalvojan toimiin perehdyttiin kuvitteellisen esimerkkitapauksen avulla. Kuvitteellisessa tapauksessa päämiehellä on metsätilan hallintaoikeus, jonka hän on itse pidättänyt itselleen. Lahjakirjaan ei ole kirjattu erityisehtoja hallintaoikeuden sisällöstä ja edunvalvojan tiedossa ei ole, onko hallintaoikeus rekisteröity Maanmittauslaitoksella. \n \nTämän työn toteuttaminen oli haastavaa, koska jokainen päämies ja hänen metsätilan hallintaoikeutensa ovat erilaisia, jolloin yleispätevää ohjeistusta ei voi antaa. On kuitenkin olemassa tietyt asiat, jotka tarkistamalla ja huomioon ottamalla edunvalvoja pääsee jo pitkälle. Opinnäytetyön tuotoksena syntyi lyhyt ja ytimekäs ohje: Muistilista edunvalvojalle, jonka päämies on metsätilan hallintaoikeuden haltija.
