Abstract
Nelle more della stipulazione di un nuovo accordo, l’utilizzo da parte dell’Italia del criterio della nazionalità – con le opportune cautele, anche di politica giudiziaria – sembrerebbe meglio riflettere l’impianto complessivo del Trattato, pur con i condizionamenti e i problemi che sono stati messi in luce. Inoltre, con specifico riguardo alla disciplina applicabile in materia di salute e sicurezza sul lavoro, l’Ente italiano che si trova a gestire la Stazione Concordia dovrebbe garantire, indipendentemente da una identica volontà per parte francese, gli standard di tutela previsti dall’ordinamento italiano e, qualora più elevati, quelli previsti dalla legislazione francese di riferimento, almeno nei confronti di coloro a cui l’Italia abbia rilasciato un’autorizzazione a svolgere un’attività all’interno dell’area antartica in cui il Trattato trova applicazione, nonché nei confronti di co- loro che facciano parte di una spedizione diretta verso o eseguita all’interno dell’Antartide che sia stata organizzata nel o sia partita dal territorio italiano.
