Abstract
Il lavoro opera una dettagliata analisi della sentenza della Corte di giustizia dell’U.E. del 20 ottobre 2022, resa nella causa C-111/21, nella quale i giudici di Lussemburgo si sono, per la prima volta, soffermati sulla potata applicativa da riconoscere alla locuzione «bodily injury» presente nell’art. 17.1 della Convenzione di Montreal 1999 sul trasporto aereo internazionale. Dopo aver ricostruito il quadro assiologico sotteso al testo uniforme del 1999 ed aver individuato le problematiche terminologiche e traduttive sollevate dalla norma uniforme, il contributo ripercorre i lavori preparatori della Convenzione del 1999 e l’iter logico-giuridico seguito dalla Corte europea. Esso, infine, procede a contestualizzare la pronuncia della Corte europea nell’ambito della giurisprudenza internazionale in materia.
