Mediante el presente estudio se busca evidenciar el sufrimiento que se vive en nuestro país diariamente con el flagelo de las minas antipersonal, así como también se muestra las medidas legislativas nacionales e internacionales, y los mecanismos al interior de la estructura del Estado con el fin de dar cumplimiento a los tratados internacionales, como el Tratado de Ottawa, transformando nuestro territorio en un territorio libre de minas y específicamente libre del uso de armas de ataque indiscriminado proscrito por el derecho internacional. Adicionalmente, la parte central y final de la investigación se encuentra basada en un análisis jurisprudencial de las sentencias emitidas, para el tema de las minas antipersonal, por el Consejo de Estado y la Corte Constitucional, en las cuales se determina si existe o no responsabilidad por parte del Estado. Este estudio es realizado de forma individual en los siguientes títulos de imputación: responsabilidad sin falta por ministerio de la ley, responsabilidad por falla del servicio, responsabilidad por riesgo excepcional, responsabilidad por daño especial y por último se analiza la posición jurisprudencial que niega la existencia de cualquier tipo de responsabilidad y habla de solidaridad.
