Le peculiarità strutturali del federalismo canadese

Abstract
Il Canada costituisce un laboratorio costituzionale con particolari tratti caratteristici. Dopo un'introduzione storica necessaria per comprendere a fondo le caratteristiche del federalismo che lo contraddistingue, viene analizzata la controversa questione del Québec, e la sua volontà di non partecipare al progetto di patriation costituzionale. In seguito viene posta l' attenzione sulla struttura interna dell'ordinamento canadese, analizzando le due parti che strutturano il Constitution Act del 1982, gli aspetti organizzativi e la Canadian charter of Rights and Freedoms nei suoi più importanti principi, e osservando come essi sono strutturati alla luce del federalismo. Infine vengono analizzati aspetti peculiari quali il bilinguismo e il carattere del multiculturalismo presenti in Canada ed estremamente caratteristici, per poi concludere con una comparazione tra il federalismo statunitense e quello canadese.
