Abstract
En la investigación que se presenta a continuación, se ha tenido como objetivo determinar si existen omisión de actos de investigación en la etapa preliminar en el delito de receptación en la Primera Fiscalía Provincial Penal de Jaén en el año 2021. En cuanto al método utilizado èste fue el descriptivo y su diseño - fenomenológico, cuyo enfoque es el cualitativo, esto debido a que es a través de una guía de entrevista que se logró recoger la información de los sujetos entrevistados, los cuales fueron Abogados penalistas litigantes especialistas y con experiencia en el patrocinio del delito de receptación, para la realización del trabajo se tuvo como escenario de estudio la Primera Fiscalía Provincial Penal de Jaén. En ese sentido, y previo procesamiento de los datos, se obtuvieron los resultados, mediante los cuales, se llegó a la conclusión que, el fiscal omite realizar actos de investigación en la etapa preliminar al investigar el delito de receptación, pues al recabar sus elementos de convicción, estos no tienden a determinar la existencia del “delito previo” y del elemento “debía presumir” tal como lo exige el artículo 194º del Código Penal.
