Abstract
Les droits fondamentaux des travailleurs peuvent représenter des contraintes à respecter pour les employeurs et, inversement, certaines libertés économiques dont bénéficient les entreprises peuvent avoir un effet contraignant sur leurs travailleurs. Partant de cette affirmation, on peut dès lors conclure que les droits fondamentaux des travailleurs et les libertés économiques des entreprises peuvent rentrer en conflit. Lâobjet de ce mémoire sera dâanalyser ce conflit et la manière dont la jurisprudence lâa résolu et de considérer différentes pistes de solutions futures proposées par la doctrine.
