La STCJE de 18 de diciembre de 2007, asunto Laval un Partneri, C 341/05 ha sido fuertemente criticada por lo sindicatos europeos al considerarse que supone la legalización del dumping social dentro de la Comunidad. Un análisis más detenido de la sentencia pone de manifiesto, sin embargo, lo apresurado de tal interpretación.
