Abstract
La nota riguarda il caso di un passeggero che ha agìto nei confronti della compagnia aerea al fine di ottenere un risarcimento dei danni conseguenti a un infortunio subìto a bordo della navetta incaricata di portare i viaggiatori al velivolo. Egli ha ravvisato la responsabilità del vettore aereo. Poiché, per l’art. 949-ter c. nav., i diritti derivanti dal contratto di trasporto di persone sono regolati dalle norme sulla decadenza previste dalla disciplina internazionale in vigore in Italia, ai sensi dell’art. 941 c. nav., il giudice ha applicato la Convenzione di Montreal del 1999 e, sulla base del suo art. 35, ha dichiarato la decadenza dall’azione di responsabilità, in quanto proposta dopo lo spirare del termine biennale previsto dallo stesso art. 35.
