Le sujet de recherche vise à étudier la question de la brevetabilité des gènes humains dans un contexte plus large de questionnement de la brevetabilité du vivant et d'appréhension de ces concepts par le droit de la propriété industrielle. Le régime établi depuis les années 2000 en France a consisté à introduire les gènes humains au sein de la brevetabilité. L'adéquation des critères propres au droit des brevets au regard de la spécificité de l'objet interroge, ainsi que le choix même d'intégrer les gènes au sein de la brevetabilité. L'étude des gènes non codants, des techniques de clonage et de modification des cellules souches est exclue. Seuls les gènes codants ayant une fonction spécifique seront traités. Des incursions sont réalisées dans le but de comparer l'état du droit aux États-Unis et au Canada aux principes adoptés au sein de l'Union Européenne. Ces incursions permettent de mettre en exergue les points communs et divergences ainsi que de questionner l'opportunité des différentes positions adoptées. Le sujet soulève des enjeux de nature juridique mais également éthique et politique. Le corps humain est un sujet particulièrement délicat, propre à soulever de nombreuses controverses. Sa brevetabilité interroge mais participe du progrès scientifique. Bien qu'il n'y ait pas une actualité législative forte concernant la brevetabilité des gènes humains, le sujet de recherche présente une acuité au regard du développement incessant des biotechnologies, élargissant le champ des possibles en la matière et interrogeant la nécessité d'une modification du régime juridique existant. Tout particulièrement, le ciseau moléculaire CRISPR-Cas9 remet en question de nombreux concepts établis.
