Opinnäytetyön tarkoituksena on luoda lukijalle ymmärrys suhteellisen uudesta ja Suomessa vähän tutkitusta oikeudenalasta, muotioikeudesta ja muotioikeuden kautta kertoa kuluttajien oikeuksista sekä velvollisuuksista muotiverkkokaupassa. Koska muoti koskettaa jollain tavalla meitä kaikkia ja muotiteollisuus on myös satojen miljardien eurojen bisnes, on tärkeää tietää, millaisia juridisia kysymyksiä muotiteollisuus sisältää. \n \nOpinnäytetyössä ostoskanavana toimii verkkokauppa. Verkkokaupassa sovelletaan kuluttajaoikeutta, joka on yksi muotioikeuden osa-alue. Kuluttajaoikeus muun muassa määrittää kuluttajien oikeudet ja velvollisuudet verkkokaupan ostoprosessin eri vaiheissa. Tyypillisesti ostoprosessiin kuuluu markkinointi, tuotteiden valinta, rekisteröityminen, tilaus, maksaminen, tuotteiden toimitus sekä mahdollinen tuotteiden palautus tai kaupan peruuttaminen. Opinnäytetyössä selvitetään, millaisia oikeuksia ja velvollisuuksia kuluttajilla on näissä verkkokaupan ostoprosessin vaiheissa. Tutkimusmenetelmänä opinnäytetyössä on käytetty lainopillista eli oikeusdogmaattista tutkimusmenetelmää. \n \nOpinnäytetyössä huomioidaan ja otetaan kantaa myös kuluttajien vastuuseen muotikulutuksessa. Muotiteollisuuden ollessa yksi maailman saastuttavimmista aloista, on myös kuluttajien muutettava ostokäyttäytymistään, jotta alan tuottamat hiilidioksidipäästöt ja hävikki saataisiin kuriin. Vastuullisuus sekä liiketoiminnassa että kuluttajien ostokäyttäytymisessä on tullut jäädäkseen. \n \nKeskeisimpänä opinnäytetyössä on EU-direktiivin 2011/83/EU tuomat muutokset Suomen kuluttajansuojalakiin sekä sen luoma lainsäädännön yhtenäisyys kaikkien Euroopan maiden välillä. Direktiivin myötä jokaisella EU-kansalaisella on yhtäläiset oikeudet EU-alueen muotiverkko-ostoksissa. Keskeistä on myös, että kansalaiset ymmärtäisivät laajat oikeutensa verkkokaupassa ja osaisivat hyödyntää lainsäädännön tuomaa oikeussuojaa. Direktiivi koskee kuitenkin vain EU-aluetta, jonka vuoksi opinnäytetyö päättyykin kysymykseen: EU-maissa kuluttajaoikeus on jo hyvällä mallilla, mutta entä muualla maailmassa?
