Il lavoro costituisce un primo commento alla disciplina della Convenzione di Montreal del 28 maggio 1999 in materia di unificazione di alcune norme relative al trasporto aereo internazionale. L’analisi verte, in modo particolare, sull’interpretazione delle norme di cui agli articoli 26, 27 e 49 della Convenzione che regolano la derogabilità della normativa. In assenza di un panorama giurisprudenziale di riferimento (in ragione della recente entrata in vigore della normativa) l’obiettivo è verificare se, ed in quale misura, le soluzioni interpretative offerte dalla giurisprudenza internazionale, formatasi sotto il vigore della convenzione di Varsavia del 1929, possano essere estese alla nuova disciplina.
