Abstract

Resumen: El propósito de este estudio es presentar, a partir de lo resuelto por la Suprema Corte de Canadá en el marco del caso mencionado, un desarrollo en torno al balance que realiza esa sede respecto del derecho a la libertad religiosa en su aspecto comunitario (y más precisamente, en el ámbito educativo) con dos valores que se encuentran en el centro del debate actual: la tolerancia y la neutralidad estatal. En efecto, a partir de la jurisprudencia (nacional e internacional) y de la doctrina citada por los magistrados, así como también desde la misma idiosincracia del pueblo canadiense, se analizarán cada uno de los conceptos antes mencionados, y la resolución adoptada por la Corte donde se enuncia que tolerancia y neutralidad estatal no implican negación de la dimensión religiosa de la persona humana, sino justamente, convivencia pacífica que lleve al desarrollo pleno del hombre. Finalmente, se extraerán conclusiones respecto de las consecuencias jurídicas que podrían derivarse del caso en lo relativo al desarrollo del la libertad religiosa en el ámbito educativo como derecho fundamental.
