Viene esaminato il nuovo assetto delle fonti di regolazione del rapporto di lavoro nelle pubbliche amministrazioni, alla luce del d. lgs. 150/2009 (decreto Brunetta), dando conto dell'ampliamento del ruolo della fonte legislativa rispetto alla fonte negoziale (prevalenza della legge sul contratto, imperatività delle disposizioni normative, inserzione automatica di clausole legali nei contratti, riduzione dell'ambito di intervento della contrattazione). Si esamina anche il rapporto fra le fonti del rapporto di lavoro e le fonti di disciplina dell'organizzazione degli uffici pubblici, con particolare riferimento ai poteri "datoriali" dei dirigenti e ai limiti fissati per la partecipazione sindacale.
