While employing section 38 of the Immigration and Refugee Protection Act 2001 (IRPA) as a backdrop, this thesis aims to measure how the presence of the 'problem migrant' deconstructs the new age conception of social citizenship rights in Canada.Significant themes have arisen through the empirical data that suggest the inherent complexities of state responsibility, intricacies of accessible social resources and the absence to adopt full agency under Canada's Neo-liberal/ Universalist hybrid welfare state.While the empirical findings expose a neo-liberal and ableist welfare state agenda embodied through a restrictive immigration policy, this thesis further demonstrates the real-life repercussions for the intersectional identity of the new immigrant with a disability.The research suggests when state accountability decreases, accessibility to social rights are ceased and in turn, personal agency cannot be fulfilled leading to the creation of a second class citizenship regime, or a 'dis-citizenship' (coined by Pother and Devlin).A minority model approach is implemented to structure inclusive and progressive policy recommendations in hopes to secure social rights and bring awareness to disability issues for new immigrant communities in Canada.
