Abstract
ABSTRAK \n \nSetiap daerah di Indonesia memiliki caranya masing-masing dalam pelaksaan pembagian waris dikarenakan Indonesia adalah negara yang beragam suku, budaya. Dalam ketentuan Allah mengenai warisan sudah jelas disebutkan dalam Surat An-Nisa’ ayat 11 bahwa anak laki-laki adalah dua kali lebih besar daripada anak perempuan. Masyarakat Desa Tumpu Kecamatan Bolo Kabupaten dalam pembagian warisan masih menggunakan sistem hukum adat yaitu dengan cara mbolo radampa untuk mencapai pembagian waris yang seimbang antara anak laki-laki dan perempuan dengan asas kemanfaatan. \n \nMetode penelitian yang digunakan adalah metode penelitian empiris. Peneliti memaparkan pembagian warisan di Desa Tumpu Kecamatan Bolo Kabupaten Bima, dan menjadikan tokoh agama, budayawan dan juga masyarakat sebagai sumber data primer. Teknik pengumpulan data dalam skripsi ini dengan cara wawancara. Data yang telah dikumpulkan kemudian dianalisa dan ditarik kesimpulan. \n \nHasil dari penelitian ini adalah pertama: masyarakat Desa Tumpu Kecamatan Bolo Kabupaten Bima melakukan pembagian waris dengan cara Mboloradampa atau musyawarah Mufakat untuk mencapai kesepakat bersama. Dengan cara mbolo radampa, mengacu pada asas kemanfaatan pembagian bisa menghasilkan 2:1 seperti dalam Al-Qur’an bahasa Bima: Salemba: Sancuu’ Salemba artinya sepikul, yaitu 2 (dua) bagian untuk anak laki-laki, dan Sancuu’ artinya sejinjing, yaitu 1 (satu) bagian untuk anak perempuan, dan yang kedua 1:1 Bahasa Bima: sancuu, sancuu. Sancuu, artinya sejinjing, yaitu 1(satu) bagian untuk anak laki-laki dan 1(satu) bagian pula untuk anak perempuan berdasarkan mboloradampa. kedua: pembagian warisan Munawir Sjadzali dengan pembagian waris masyarakat Desa Tumpu memiliki kesamaan dan perbedaan. Persamaanya yaitu sama-sama menghsilkan 1:1 sedangkan perbedaan terletak pada asas kemanfaatan dan asas keadilan distributif antara anak laki-laki dan perempuan. \n \nABSTRACT \n \nEvery region in Indonesia has its own way of implementing inheritance distribution because Indonesia is a country that has various ethnicities and cultures. In Allah's provisions regarding inheritance, it is clearly stated in Surah An-Nisa' verse 11 that boys are twice as big as girls. The people of Tumpu Village, Bolo District, in the distribution of inheritance still use the customary law system, namely the mbolo radampa method to achieve a balanced distribution of inheritance between sons and daughters on the principle of expediency. \n \nThe research method used is empirical research method. The researcher describes the division of inheritance in Tumpu Village, Bolo District, Bima Regency, and uses religious leaders, cultural figures and the community as primary data sources. Data collection techniques in this thesis by way of interviews. The data that has been collected is then analyzed and conclusions are drawn. \n \nThe results of this study are first: the people of Tumpu Village, Bolo Subdistrict, Bima Regency carry out the division of inheritance by Mboloradampa or consensus deliberation to reach mutual agreement. With the mbolo radampa method, referring to the principle of expediency, the division can result in 2:1 as in the Bima language Al-Qur'an: Salemba: Sancuu' Salemba means sepikul, which is 2 (two) parts for boys, and Sancuu' means sejinjing, which is 1 (one) part for girls, and the second 1:1 Bima language: sancuu, sancuu. Sancuu, meaning sejinjing, namely 1 (one) share for boys and 1 (one) share for girls based on mboloradampa. Second: Munawir Sjadzali's division of inheritance with the division of inheritance of the Tumpu Village community has similarities and differences. The similarity is that they both produce 1:1 while the difference lies in the principle of expediency and the principle of distributive justice between boys and girls. \n \nمستخلص البحث \n \n إندونيسيا لها طريقتها الخاصة في تنفيذ تقسيم وريث, لأن إندونيسيا بلد به أعراق وثقافات مختلفة. ورد في أحكام الله في الوريث صراحة في سورة النساء الآية 11 أن رجل أكبر من نساء. المجتمع تومبو بولو عندهم الحكم العرف في تقسيم الوريث هو بطريقة مولو ر دمف mbolo ra dampa لتقسيم الوريث يعتدل لنفع بين رجل و نساء \n \nهذ البحث العلمي هي البحث التجريبية. الباحث يفيد تقسيم وريث في قرية تومبو بولو بيما. و أما مصدر الأول في هذ بحث منها العلماء, الثقافية, و لمجتمع. تقنيات جمع البيانات في هذ بحث الرسالة باالمقابلات. ثم يتم تحليل البيانات التي تم جمعها واستخلاص النتائج. \n \nالحاصل الأول من هذا الإستقراء هو أن مجتمع قرية تمفوا ناحية Bolo محافظة بيما يحققون تقسيم الورثة بكيفية Mboloradampa او مشاورة لحصول على اتفاق واحد جماعة. بهذه الكيفية ( mbolora dampa) ، انطلاقا من فائدة أساسية أن التقسيم يحصل على ٢:١ كما كتب في القرآن بلغة بيما : salemba : sancuu Salemba بمعنى sepikul او قسمان لولد و sancuu' بمعنى sejinjung او قسم واحد للولدة . والثاني ١:١ لغة بيما : samcuu, samcuu. Sancuu, بمعني sejinjing يعني قيم واحد للولد و هكذا للولدة بناء على mboloradampa. والثاني : تقسيم الورثة منور شذالي و مجتنع تمفوا فيهما متساوية و مختلفة أيضا . من جهة متساوبة أنه يحصل على ١:١ أما إختلافه يقع على أساس منفعة و عدالة الإعطاء بين الرجال و النساء
