Les erreurs dans les cours de justice sont possibles et bien réelles encore de nos jours. La procédure en droit pénal a connu au cours des derniers siècles des modifications et mutations signes de son évolution. Citons comme exemple : les contrôles en cours d'enquête et les avancées technologiques rendant la preuve plus certaine ; les protections supplémentaires accordées à la personne accusée comme droits et garanties afin de la protéger ainsi que l'efficacité procédurale, nouvel enjeu pour réduire les délais passant par le plaidoyer de culpabilité. Or, il demeure toujours impossible de totalement contrer l'erreur judiciaire. Dans ce mémoire, nous étudierons les erreurs judiciaires et la demande en révision de la condamnation pénale en droit français et canadien. Nous nous attarderons particulièrement à l'erreur née durant l'enquête qui se perpétue en l'instance, en identifiant ses causes, et les moyens en place pour la contrer. Ainsi, nous pourrons déterminer si ceux-ci sont efficaces dans les faits. Enfin, nous examinerons plus attentivement dans les deux régimes le remède prévu à l'erreur judiciaire qu'est la demande en révision afin de bien comprendre les motifs pour y accéder et ainsi déterminer son efficacité comme réparation du tort subi par la personne condamnée, mais innocente suite à une condamnation définitive.
