Suomen varautuminen muuttoliikettä hyväksikäyttäviin hybridiuhkiin ihmisoikeusnäkökulmasta

Abstract
Hybridiuhkat sekä uudenlaiset tavat vaikuttaa naapurivaltioihin ovat selkeästi yleistymässä. Yksi näistä tavoista on muuttoliikkeen välineellistäminen, ja lakiehdotuksia sekä muutoksia tämänlaisiin uhkiin vastaamiseksi on tehty myös Suomessa. Työn tavoitteena on analysoida viime aikoina tehtyjä lakiehdotuksia sekä jo hyväksyttyjä lakeja siitä näkökulmasta, ovatko ne linjassa Suomen turvapaikanhakijoita koskevien ihmisoikeusvelvoitteiden kanssa. Analyysissä käsitellään nimenomaan rajavartio-, vastaanotto-, ulkomaalais- ja valmiuslain uudistuksia ja muuttamisehdotuksia, ja näitä tutkitaan muun muassa kansainvälisen suojelun, palautuskiellon ja turvapaikanhaun menettelyllisten oikeuksien näkökulmasta. Tutkielma osoittaa, että ehdotuksissa ja lakimuutoksissa on huomioitavaa ihmisoikeuksien näkökulmasta ensinnäkin itse lakitekstien tasolla sen varmistamiseksi, etteivät Suomen säännöt ole ristiriidassa kansainvälisten- ja EU-velvoitteiden kanssa, sekä lakien soveltamisen tasolla niin, etteivät muutokset rikkoisi turvapaikanhakijoiden oikeuksia käytännössä.
