Abstract
Im Nachgang zu den Entscheidungen des Europäischen Gerichtshofs in den Rechtsachen Viking und Laval wurde vom Europäischen Gewerkschaftsbund die Forderung an die Mitgliedstaaten gerichtet, ein soziales Fortschrittsprotokoll zu verabschieden. Damit sollen die sozialen Rechte gestärkt und die eingetretene Asymmetrie im Verhältnis zu den Grundfreiheiten korrigiert werden. Diese berechtigte Forderung ist allerdings bisher von den Vertragsparteien nicht aufgegriffen worden. Mit dem vorliegenden Gutachten soll das Potenzial eines solchen Protokolls näher ausgeleuchtet werden. Der Gutachter schlägt vor, die im sozialen Fortschrittsprotokoll angedachten Lösungsansätze in das europäische Primärrecht fortzuentwickeln. Eine Möglichkeit hierfür könnte sich bei künftigen Vertragsrevisionen bieten, die zu einem Ausbau der sozialen Dimension der Wirtschafts- und Währungsunion führen. Denn bei allen unterschiedlichen Bewertungen ist klar, dass das Europa der Zukunft sozialer gestaltet werden muss.
