L’étude de la genèse des systèmes dits mixtes en droit comparé met en lumière deux processus de construction. Le premier découle d’une interaction historique au XIXème siècle entre deux systèmes souches, le civil law et la common law. En Afrique du Sud, en Louisiane, en Écosse, en Israël, au Québec, aux Philippines et à Porto Rico, ces différents systèmes ont évolué en parallèle, nonobstant la distance et une absence de communication entre eux. Malgré cette absence initiale de dialogue entre les systèmes mixtes, on observe que ce sont les mêmes acteurs qui agissent : la doctrine, le législateur et le juge ont joué un rôle crucial et prépondérant dans la construction desdits systèmes. Ces derniers se sont ainsi construits de manière identique, développant une architecture spécifique quant aux domaines régis par la common law ou le civil law formant, dans le même temps, différentes strates d’imbrication et de mélange entre les deux systèmes souches. Un second processus s’engage alors : celui de l’émancipation des systèmes mixtes du fait de l’insuffisance de la dialectique civil law – common law pour les définir de manière pertinente dans leur entièreté. En effet, l’étude approfondie permet de mettre en lumière l’émergence de nouveaux concepts juridiques propres aux systèmes mixtes, mais aussi une influence et un rayonnement de ces derniers sur d’autres systèmes de droit. La thèse a donc pour vocation de présenter les systèmes dits mixtes dans leur globalité afin de mieux souligner leurs spécificités menant à la création d’une nouvelle et réelle famille de droit à part entière.
