La Commission des droits de la personne et des droits de la jeunesse [CDPDJ] a recommandé que soit intégré un droit à la santé au chapitre des droits économiques et sociaux de la Charte québécoise. Or, la LSSSS accorde déjà plusieurs droits aux usagers du système de santé québécois, dont le droit d’accès aux services de santé. Cette loi impose également plusieurs obligations aux établissements de santé, notamment celui de dispenser des services de santé sécuritaires et de qualité. Le présent essai vise à comprendre les motifs juridiques de la recommandation de la CDPDJ concernant la reconnaissance d’un droit à la santé dans la Charte québécoise, considérant l’existence d’autres dispositions législatives accordant des droits aux usagers du système de santé québécois. Cet essai révèle que la législation canadienne, n’accorde pas de droit à la santé à l’heure actuelle. Le contenu de ce droit s’avère toutefois protégé par la législation québécoise, via la LSSSS. Le présent essai conclut que l’intégration d’un droit à la santé dans la Charte québécoise, une loi avec un statut prééminent, serait utile, mais non nécessaire. Cette conclusion se fonde sur le rôle symbolique des droits prévus aux chartes, la hiérarchie des normes juridiques ainsi que sur le contrôle judiciaire des décisions étatiques de nature politique.
