Cette contribution vise à éclairer les débats contemporains sur le règlement des conséquences financières du divorce par une étude historique et comparative des conditions de politisation de cette question. Trois interprétations politiques de ces dispositions (pensions alimentaires, prestation compensatoire, définition des régimes matrimoniaux) sont distinguées : une lecture familialiste, une lecture protectionniste, et une lecture en termes de justice de genre. A partir d’une comparaison France-Québec, nous mettrons en évidence les conditions de possibilité d’une problématisation féministe de l’enjeu. L’analyse comparative montre que ces dispositions occupent une place beaucoup plus centrale dans les luttes féministes au Québec qu’en France. De façon corollaire, le sens qui leur est attribué diffère : perçues en France comme des instruments de protection et de maintien des femmes dans la dépendance, elles sont utilisées au Québec comme l’outil d’une justice de genre. Deux pistes explicatives de ces différences sont explorées, l’une centrée sur le profil social des militantes, et l’autre sur les significations culturelles véhiculées par le droit.
