En garantissant les libertés, un Etat se réserve le droit de les limiter. Les libertés ne sont en effet pas absolues. Elles trouvent leurs limites soit dans la nécessité de sauvegarder juridiquement l’intérêt général, soit dans la protection des droits fondamentaux d’autrui. Avec l’entrée en vigueur de la nouvelle Constitution suisse le 1er janvier 2000, un système « explicite » de limitation des droits fondamentaux a été introduit dans notre Charte fondamentale. L’article 36 Cst. établit ainsi un mécanisme destiné à protéger les droits fondamentaux lors de leur limitation. Cette disposition énonce quatre conditions de limitation : la base légale, l’intérêt public, la proportionnalité et le respect du noyau intangible. Elle a rapidement donné lieu à beaucoup de controverses dans la doctrine, en particulier la question de savoir si elle s’applique à tous les droits fondamentaux protégés par le texte fondamental. Afin de répondre à cette question, nous avons décidé d’effectuer une étude de droit comparé et de nous inspirer des solutions ou réflexions proposées dans d’autres ordres juridiques. Notre choix s’est porté sur le Canada et sur la Convention européenne des droits de l’homme. Dans un premier temps, nous avons exposé en détail le système de limitation des droits fondamentaux en Suisse. Nous avons ensuite procédé à une classification des différentes catégories de droits fondamentaux protégés par la Constitution. Enfin, nous avons examiné la question de l’applicabilité de ce système de limitation aux différentes catégories de droits fondamentaux. Ce schéma d’analyse a été repris pour les droits étrangers. Les solutions proposées par chacun des systèmes juridiques examinés ont été comparées et confrontées. Cette confrontation nous a permis de proposer certaines réponses aux questions qui se posent dans le droit suisse.
