Les systèmes canadien et français abordent le dédommagement de la victime dans le procès pénal de façon diamétralement opposée. En droit pénal canadien, le dédommagement de la victime fait partie intégrante de la peine et il s’analyse selon les objectifs de détermination de la peine. En droit pénal français, la victime peut se constituer partie civile devant la juridiction répressive afin d’intenter une action en réparation. Le juge pénal analyse alors cette demande selon les règles de la responsabilité civile. Malgré cette différence fondamentale, l’évolution de la place de la victime dans le procès pénal a suivi une évolution similaire au Canada et en France. En 2015, deux lois concernant les droits des victimes sont adoptées à quelques mois d’intervalle. Au Canada, la Loi sur la Charte des droits des victimes prétend donner à la victime des droits substantiels dans la procédure pénale, notamment un droit au dédommagement. En France, la Loi no 2015-993 du 17 août 2015 regroupe, au titre préliminaire du Code de procédure pénale, les principaux droits de la victime française dans la procédure pénale. Le régime de l’ordonnance de dédommagement prévu au Code criminel peut-il s’inspirer de l’action en réparation en droit français pour améliorer l’accès des victimes au dédommagement ? À la lumière de cette considération, le présent mémoire propose une brève étude de l’évolution historique des deux régimes, en portant une attention particulière à l’impact des récentes réformes sur le droit positif. Il propose également une analyse comparée des conditions d’ouverture, de l’analyse judiciaire et des modalités d’exécution de chacun des régimes, dans l’optique d’identifier des pistes d’amélioration pour élargir le régime de dédommagement canadien.
