Per 1 januari 2015 roept de Nederlandse wetgever in art. 7.8 Wet IB 2001 een nieuwe regeling voor een beperkte groep kwalificerende buitenlandse belastingplichtigen in het leven waardoor de huidige keuzeregeling voor buitenlandse belastingplichtigen vervalt. Het Hof van Justitie EU-arrest Imfeld & Garcet van 12 december 2013 is een mooie aanleiding om de nieuwe regeling tegen de achtergrond van de nieuwe ontwikkelingen in de Europese rechtspraak te plaatsen. De bijzondere focus van deze bijdrage ligt op de invulling van de vangnetbepaling vervat in art. 7.8 lid 4 Wet IB 2001 die tracht te voorkomen dat persoonlijke aftrekposten door de kwalificerende buitenlandse belastingplichtige of zijn partner zowel in de (buitenlandse) woonstaat als in de werkstaat Nederland in aanmerking worden genomen. Naast de aanpassing van de vangnetbepaling als tijdelijke oplossing, pleit de auteur voor een Europese oplossing.
