Com o julgamento do Recurso Extraordinário nº 636.311, com Repercussão Geral, pelo Pleno do Supremo Tribunal Federal, em 25/05/2017, foi firmada a tese de que, nos termos do art. 178 da Constituição da República, as normas e os tratados internacionais limitadores da responsabilidade das transportadoras aéreas de passageiros, especialmente as Convenções de Varsóvia e Montreal, têm prevalência em relação ao Código de Defesa do Consumidor. A utilização do art. 178 como critério para a solução de conflitos ao lado da hierarquia, cronologia e especialidade não foi a melhor escolha para decidir sobre a limitação da responsabilidade das transportadoras aéreas pelo extravio de bagagem em voo internacional, pois permite a contrariedade à Constituição Federal e limita a atividade do legislador, promovendo verdadeiro retrocesso relativamente aos direitos fundamentais do consumidor, que por serem direitos humanos positivados, deveriam prevalecer. Em vista da aplicação do precedente, é possível prever as soluções para casos semelhantes, mediante a utilização do método misto, dedutivo-indutivo, como utilizado no Direito alemão, que é didático para o ensino do Direito.
