Tulolähdejaon tausta ja merkitys Suomen yhteisöverotuksessa - näkökulmana arvopaperiluovutukset

Abstract
Tutkimuksessa käsitellään tulolähdejakoa Suomen yhteisöverotuksessa - näkökulmana yhteisöjen arvopaperiluovutukset. Tutkimuksen tarkoituksena on löytää tulolähdejaon merkitys yhteisöjen arvopaperiluovutusten verotuksessa perehtymällä tuloverotuksen osalta Suomen verotusjärjestelmään, tulolähdejaon ja luovutusvoittojen verotuksen historiaan, sekä tuomalla esiin tulolähdejaon merkityksellisimpiä verotuksellisia vaikutuksia. Pyrkimyksenä on objektiivisen tarkastelun jälkeen yrittää kyseenalaistaa tulolähdejaon tarpeellisuus yhteisöjen verotuksessa. Selvittämällä jossain määrin myös elinkeinoverolain omaisuuslajijaon merkitystä, koetetaan tutkimuksessa luoda jonkinlaista vertailua näiden kahden välille ja ehdottaa keinoa tulolähdejaon korvaamiseksi. Huomioon tullaan ottamaan myös verotuksen tavoitteet sekä hyvän verojärjestelmän ominaisuudet ja argumentoimaan tulolähdejaon merkitystä myös näiden näkökulmasta. Tutkimus on peruslähtökohdiltaan oikeusdogmaattinen, mutta pääpainoiltaan oikeushistoriallinen ja oikeuspoliittinen. Lähdeaineistossa korostuvat lain esityöt ja kirjallisuus.\n\nVoidaan sanoa, ettei yhteisöjen tulolähdejako – arvopaperiluovutusten näkökulmasta käsiteltynä – vastaa täysin hyvälle verojärjestelmälle asetettavia vaatimuksia. Ottaen huomioon, miten vähän tulolähdejako lopulta vaikuttaa verotukselliseen lopputulokseen, se aiheuttaa turhia kustannuksia verohallinnolle ja verovelvollisille itselleen. Olisi yksinkertaisempaa, jos verotettavan tulon laskenta voisi tapahtua tilinpäätöksen mukaisesti, ilman tulolähdejakoa. Tulolähdejaosta luopuminen parantaisi verovelvollisen asemaa tappiotilanteessa. Nykyistä tulolähdekohtaista tappiontasausta ei pitäisi perustella ainakaan fiskaalisilla syillä, sillä verotuksella ei saisi vaarantaa heikosti menestyvän yhteisön toimintaa. Tulolähdejako voitaisiin korvata omaisuuslajijakoa kehittämällä.
