S’il est vrai que l’innovation pharmaceutique augmente le bien-être des Canadiens, il demeure que cette innovation entraîne corollairement une hausse importante des coûts assumés, à même les fonds publics, par les provinces et les territoires du Canada. Ces derniers ont donc adopté des lois pour encadrer la mise en marché des médicaments et ainsi assurer un accès raisonnable à ces biens de première nécessité. Parallèlement, au terme de sa Loi sur les brevets, le Parlement fédéral s’est doté d’un organisme, le Conseil d’examen des prix des médicaments brevetés, ayant pour mission de protéger les Canadiens contre les prix excessifs des médicaments brevetés. Maintenant, comment garantir l’équilibre constitutionnel régissant le fédéralisme canadien alors que la réglementation des prix des médicaments relève d’une compétence législative propre aux législatures provinciales et territoriales ? Cet essai se veut donc une analyse constitutionnelle portant sur les pouvoirs du Conseil d’examen des prix des médicaments brevetés et leur mise en œuvre à la lumière de la jurisprudence.
