Longtemps éludée, la question du bien-être animal fait son entrée à l'Organisation mondiale du commerce (OMC). Le récent débat sur la chasse aux phoques permet de créer une rupture avec la tradition d'éviction de cette question à travers la protection de la moralité publique. La problématique de ce débat est la suivante : la mesure communautaire sur les produits dérivés du phoque est-elle conforme au droit du commerce international? Celle-ci vient d'être à nouveau discutée les 29-30 avril 2013 au siège de l'OMC à Genève . D'un côté, le Canada et la Norvège en tant que parties plaignantes. De l'autre, l'Union européenne (UE) devant défendre la légitimité de sa restriction commerciale. Adopté en 2009, le règlement communautaire sur les produits du phoque est entré en vigueur en 2010. Celui-ci consiste principalement à interdire l'importation et la commercialisation des produits dérivés du phoque. A priori ambitieux du point de vue de la protection du bien-être animal, les exceptions qu'il prévoit viennent néanmoins affaiblir considérablement la force morale de cette interdiction, loin d'être générale. Cet article vise à présenter les incohérences comme les innovations de ce règlement vers une prise en compte de la protection du bien-être animal à l'OMC.
