Abstract
Deze masterscriptie onderzoekt de situatie van grensoverschrijdend bouwen binnen het Belgische recht. Wanneer een bouwwerk over de perceelsgrens reikt, botst dit met het eigendomsrecht. Eigendom wordt niet langer als absoluut beschouwd, maar wordt onderworpen aan beperkingen in functie van maatschappelijke belangen. De scriptie analyseert hoe het recht een evenwicht zoekt tussen het eigendomsrecht van de benadeelde en de ontwikkelingsbelangen van de bouwer. Daarbij is de goede of kwade trouw van de bouwer essentieel: bij goede trouw komt regularisatie in beeld, bij kwade trouw kan de afbraak volgen. De recente uitspraak van het GwH van 15 april 2024 bevestigt het belang van proportionaliteit. Een rechtsvergelijking met Nederland en Québec toont een gelijkaardige evolutie naar flexibele, context gerichte oplossingen. Conclusie: het eigendomsrecht evolueert naar een dynamisch evenwicht tussen individuele rechten en maatschappelijke noden, waarbij afbraak niet langer vanzelfsprekend is.
