Abstract
Het onderwijsrecht is een dynamisch rechtsgebied. De rechten en plichten van betrokkenen in het onderwijs zijn in uitgebreide, complexe en steeds veranderende regels vastgelegd. In het onderwijs is in toenemende mate behoefte aan specialisten die beschikken over actuele kennis over de ontwikkelingen in wet- en regelgeving. Dit boek biedt een algemene, compacte en praktijkgerichte inleiding op het onderwijsrecht. Het is bedoeld voor iedereen die een globaal overzicht wil krijgen van de juridische kaders in het primair en voortgezet onderwijs, zoals studenten, juristen, directies, stafleden van besturen en medezeggenschapsraden. Deze uitgave bevat een beknopt overzicht van de uitgangspunten van artikel 23 Grondwet, van de vrijheid van onderwijs en van de belangrijkste onderwijswetten (WPO, WVO 2020 en de WEC, maar ook de WMS en de Leerplichtwet). De rechtspositie van leerlingen, ouders, bestuur en medezeggenschapsraad wordt toegelicht aan de hand van de wet, de rechtspraak en oordelen van geschillencommissies, bijvoorbeeld over de toelating en de verwijdering van leerlingen, de mate van aansprakelijkheid van onderwijsinstellingen, de beoordelingsvrijheid van leraren en de verplichtingen bij leerlingen met een handicap of ondersteuningsbehoefte.
