Abstract
This chapter chronicles the 2009 British Columbia Supreme Court hearing on the constitutionality of Canada's polygamy prohibition, as the province questions its compatibility with the Charter of Rights and Freedoms. The attorney generals of Canada and British Columbia jointly present extensive evidence, including expert testimony and lay accounts, while an amicus curiae argues that the prohibition is unconstitutional. A pivotal contribution comes from Professor McDermott, whose cross-national statistical analysis reveals strong correlations between polygyny and a range of social harms, supporting the prohibition's justification. The chief justice ultimately upholds the law, concluding that the inherent harms of polygamy outweigh any Charter violations. Finally, the chapter emphasizes the decision's enduring legal and evidentiary impact, particularly its validation of empirical data and lived experiences that collectively demonstrate the universal, structural harms of polygamy.
