Cet essai analyse de manière critique l’efficacité de la Loi visant à lutter contre la maltraitance envers les aînés et toute autre personne majeure en situation de vulnérabilité dans les milieux d’hébergement au Québec. Il examine dans quelle mesure cette loi assure réellement la prévention, la protection des droits et la responsabilisation des établissements. À partir d’une méthodologie juridique fondée sur l’analyse des rapports du MSSS et du Protecteur du citoyen, de décisions jurisprudentielles et de comparaisons internationales, l’essai met en évidence les lacunes structurelles de la loi, notamment l’absence de mécanismes contraignants, la faiblesse du régime de signalement et la responsabilité organisationnelle insuffisante. Des recommandations sont formulées pour renforcer le cadre législatif québécois, dont la codification de la maltraitance organisationnelle, la création d’un système de surveillance proactive et l’instauration d’une formation continue obligatoire favorisant une culture de bientraitance.
