Abstract
A raíz de una casación de la Corte Suprema que aplicó el Convenio de Varsovia sobre el Convenio de Montreal, el autor describe la evolución del marco legal aplicable a la responsabilidad derivada del transporte aéreo internacional en los tratados ratificados por el Perú. Asimismo, critica los fundamentos de la referida casación, defendiendo la aplicación del Convenio de Montreal ante determinados supuestos, y expone las posibles consecuencias negativas de este pronunciamiento judicial.
