Abstract
La perception de la présence des morts dans la société évolue. Ce sont moins les morts qui nous préoccupent que les transformations des sociétés face à eux, comme la manière dont elles évoluent et se métamorphosent. Plus particulièrement, les développements crématistes correspondent à un vecteur de changement de la société québécoise. Devant un taux de crémation qui s’avère en constante progression ces dernières années, le désir de crémation au Québec questionne. Dans une première partie, il est opportun de nous arrêter sur la composition de la société des morts en cendres, qui se construit paradoxalement comme un double de celle des vivants : quelle est la nature juridique de la dépouille humaine et de ses cendres? Dans une seconde partie, il convient d’observer le traitement juridique des cendres humaines depuis l’entrée en vigueur de la Loi sur les activités funéraires, en 2019. Au vecteur de la dignité de la personne décédée se greffe désormais l’interdiction de nuire à la dispersion des cendres humaines. Le traitement emprunte de manière transversale aux droits de la personne et des biens, mais également aux droits successoral, municipal et environnemental.
