Cet article examine la possibilité d’implantation d’un équivalent fonctionnel à la théorie de l’imprévision en droit québécois à la lumière des conclusions de la Cour suprême du Canada dans l’affaire Churchill Falls (Labrador) Corp. c . Hydro‑Québec, tranchée en 2018. La Cour, dans cette affaire, confirme que la théorie de l’imprévision n’existe pas en droit québécois, mais, de son propre aveu, cela ne veut pas pour autant dire qu’un mécanisme similaire ne puisse être invoqué grâce aux outils dont dispose le droit civil. Une analyse descriptive de la théorie de l’imprévision, à travers le prisme du droit comparé, informe d’abord le lecteur sur les contours généraux de cette théorie. Ce survol comparatif éclaire ensuite une analyse technique qui explore la possibilité et les paramètres d’une intervention judiciaire, en cas d’imprévision, fondée sur les exigences du devoir général de bonne foi. Loin d’être morte et enterrée, contrairement à ce que laissent entendre les tribunaux depuis 2018, la théorie de l’imprévision, dans une certaine forme, possède un avenir prometteur en droit civil québécois, soutient l’auteur.
