Abstract
Ce mémoire traite du droit à la participation des enfants en milieu scolaire québécois à la lumière de la Convention relative aux droits de l’enfant. Dans un premier temps, nous présentons les fondements historiques et la portée juridique du droit à la participation des enfants, et en proposons des éléments de définition. Nous retraçons dans un deuxième temps l’historique de l’école et de l’éducation, l’appréhendons ensuite à travers une approche contemporaine globale, et terminons par une étude du droit québécois de la participation en milieu scolaire. Enfin, nous consacrons notre dernière partie à l’évaluation de l’effectivité du droit à la participation des enfants en milieu scolaire québécois à travers les opinions des principaux concernés : les enfants.
